The short version

1. Who these terms are with

These terms are an agreement between you and Tamir Sobel, d/b/a Texas New-Business Radar ("we", "us"), which runs Texas New-Business Radar ("Radar") at texasbizradar.com. By requesting a sample, subscribing or using Radar, you agree to these terms. If you use Radar for a company, you're agreeing for that company and confirm you're allowed to.

2. What Radar is

Radar is a subscription list of businesses that recently received a Texas sales-tax permit, drawn from the Texas Comptroller of Public Accounts' public open data. We clean, de-duplicate, label and filter that data (for example, by metro, industry and likely insurance need) and deliver it by email as a digest and a spreadsheet. Radar is an independent service. It is not affiliated with, endorsed by or sponsored by the Texas Comptroller or any government agency.

3. Free sample

The free sample is a one-time set of about 25 businesses so you can judge the data. No card is needed, and requesting one doesn't sign you up for anything paid. By requesting it you agree that we may email you about it and about Radar; you can unsubscribe at any time.

4. Plans, billing and cancellation

5. How you may use the lists

While you're a customer, you may use the lists for your own business: to research, prospect and contact the businesses, and to load them into your own CRM or spreadsheets. Statewide/Team plans may share them with up to 3 named users in the same company. You may not resell, sublicense, publish or redistribute the lists (in whole or in substantial part) as a list or data product, or use them to build a competing service. Records you've already loaded into your CRM and worked can stay there after you cancel. The underlying state records are public; this license covers our compiled, cleaned and labeled lists.

6. Your responsibilities when you contact businesses

You alone decide whether and how to contact anyone on a list, and you're responsible for doing it lawfully. That includes the CAN-SPAM Act for email, the Telephone Consumer Protection Act (TCPA) and the National Do-Not-Call Registry for calls and texts, Texas telemarketing and marketing laws, and the licensing and advertising rules of your own industry (for example, Texas Department of Insurance rules). Lists don't include phone numbers or emails, and we don't promise anyone on a list has agreed to be contacted. If a business asks you to stop contacting it, stop.

7. About the data

The data comes from state records that businesses fill out themselves, and it's refreshed on the state's schedule (currently weekly). Industry codes can be wrong, businesses can close or never open, addresses can be incomplete, and our labels ("likely insurance need", "fit" scores, chain and location flags, suggested coverages) are automated estimates, not professional or insurance advice. We work to keep the data accurate and timely, but we don't guarantee that any list is complete, correct or current, or that it will produce any particular sales. If the state's source data is late or broken, we may hold a delivery rather than send bad data, and we'll tell you.

8. Acceptable use

Don't use Radar to harass, discriminate against or stalk anyone, to send spam, to commit fraud, or for any unlawful purpose. Don't try to break, overload or scrape our systems, and don't share your account with people outside your plan. We may suspend or end access for violations; if we end your access without cause, we'll refund any prepaid unused period.

9. Disclaimers

Except as stated in these terms, Radar and all lists are provided "as is" and "as available", without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the fullest extent the law allows.

10. Limitation of liability

To the fullest extent the law allows, we won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business or data. Our total liability for any claim relating to Radar is limited to the amount you paid us in the 3 months before the claim arose (or $50 if you've only used the free sample). Some jurisdictions don't allow certain limits, so some of these may not apply to you.

11. Indemnity

If someone brings a claim against us because of how you used the lists (for example, your calls, texts or emails to a business), you agree to cover our reasonable costs and losses from that claim.

12. Changes and ending these terms

We may update these terms. We'll post the new version here, update the date below and, for material changes, email customers at least 15 days before they take effect. If you don't agree, cancel before then. You can stop using Radar at any time.

13. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Texas, and both sides agree to that venue. Before filing anything, please email hello@texasbizradar.com so we can try to resolve it informally.
